Advice for Proving a Disability

Our law firm uses a variety of techniques to establish the nature and extent of a disabling condition:

  • Keeping a personal diary: We may ask a person with chronic fatigue, for example, to make note of how often and how long they need to rest during the day. A person with migraines can list the symptoms they experience, and their duration and severity.
  • Documenting third-party observations: We may ask people who knew the person before and after the condition to describe the differences they have witnessed.
  • Working with your doctor: In every case, we try to involve the treating physician, nurse, practitioner, psychologist or psychiatrist in describing the condition in a manner that the Social Security Administration will find meaningful. A medical record that notes a back injury prevents the patient from sitting or standing for more than one hour is more useful than one that states the patient is disabled by a back injury.
